October 16, 2006Mississippi woman wins settlement in mesothelioma lawsuit

A woman from Mississippi has reached a settlement in her mesothelioma lawsuit against the four companies whose construction products she alleged to have caused her illness. The terms of the settlement will be kept confidential said her mesothelioma attorney, G. Patterson Keahey. 

Patsy Jean Bodkin’s father and brother owned a homebuilding business in Corinth, Mississippi. In her suit, she said that since she was a child, she used to shake the dust off of their clothes and wash them. This dust contained asbestos, which eventually caused Bodkin to receive a mesothelioma diagnosis. In 2003, she began to have trouble breathing and went to see her doctor, who told her that she had mesothelioma.

The four companies named in Bodkin’s mesothelioma lawsuit were Georgia-Pacific Corp., Kelly-Moore Paint Co., Bondex International Inc. and Certainteed Corp. Bodkin’s mesothelioma lawyer said that even though the link between mesothelioma and asbestos has been known since before the 1960s, none of the four companies warned the public about the potential health risks of their products.

Although Certainteed refused to admit that its products were to blame for Bodkin’s mesothelioma diagnosis, the three other defendants in her lawsuit were more willing to admit their role in her illness. “We believe if people have injuries or illnesses that were caused by asbestos-containing products that are our products, these people should be compensated,” a spokesman for Georgia-Pacific says.
